Imam al-Nasāʾī’s Jurisprudential Views on Family Law: An Analytical Study

Abstract

This research aims to examine the jurisprudential views of Imam al-Nasa'i regarding family matters, drawing upon the chapter headings (tarājim) found in his work Sunan al-Nasa'i within a comparative jurisprudential framework. The study seeks to outline the biography of Imam al-Nasa'i, introduce his book al-Sunan al-Sughrā (The Concise Sunan highlighting its significance and scholarly standing and identify his key views on family law rulings. The research employs an inductive approach to derive al-Nasa'i’s jurisprudence from al-Sunan al-Sughrā by analyzing his chapter headings and commentary notes. Additionally, it utilizes a descriptive-analytical method to examine these headings and his remarks on the hadiths, thereby revealing Imam al-Nasa'i’s jurisprudential insights across various fields of Islamic law.
