The emergence of the Legal registration of marriage and the stages of its development in Islamic jurisprudence and the present era

Abstract

Perhaps many are ignorant of the historical depth of the marriage legal registration , which is linked to the most solemn contract. Rather, they may ignore the scholars’ care for this profession, and the conditions, controls and privileges they drew, which requires shedding light on this matter, and standing on the wide existence in the history of Islamic jurisprudence of this profession. Also, the historical stages that this profession went through, and the care it received from Islamic governments, caused a major change in its controls, reality, and obligations, especially in the present era. Therefore, the aim of this research was to clarify the beginning of the emergence of the profession of legal registration of marriage in the history of Islamic jurisprudence, and to stand on the most prominent stages of its development and its effects, and to clarify the features of its development in the present era, with an indication of the impact of modern technologies and systems on the mastery and quality of the work of this profession, and what is related to it, through: The authorized person, the contract, the documentation, and the regulations that governing that Using in my study this descriptive inductive approach, by tracing the jurisprudential history of legal registration of marriage and its development, then rearranging and describing it. The researcher has reached the depth of the historical roots of the profession of legal registration of marriage, and stood on the manifestations of the scholars' care for this profession and those who in charge of it Likewise, Islamic governments have actively sought to develop this profession and tighten its controls through laws and regulations. The concerned authorities have also adapted modern technologies to develop this profession and what is related to it. The Ministry of Justice in the Kingdom of Saudi Arabia took the lead in this, by keeping abreast of the latest technologies and applications serving this honorable profession, which had a great positive impact on validaty, accuracy, quality, speed, and facilitation.
