Abstract

In this research, the researcher examines the methodology of Sheikh Al-Ithiyubi in weighing conflicting legal evidence. This is done by examining the issues and texts that Sheikh Al-Ithiyubi presented in his works, which show apparent conflict, and then clarifying the Sheikh's approach to weighing between them. The problem of this research is how to explain the approach and methodology of the scholar Muhammad bin Ali bin Adam Al-Ithiyubi in weighing conflicting evidence, while clarifying the extent of his adherence to the rules of resolving conflict among the fundamentalists and their application to his opinions in the branches of jurisprudence. The research includes an introduction, a preface, four sections, and a conclusion. The introduction includes the research problem, its objectives, and the researcher's methodology. The preface contains an introduction to Sheikh Al-Ithiyubi, the process of weighing evidence, and its most important conditions. The first section addressed al-Ithiyubi's methods of preference, while the second section examined his preference based on the chain of transmission (isnad). The third section dealt with preference based on the text (matn), and the fourth section addressed preference based on an external factor.
