Abstract
Praise be to Allah, and prayers and peace be upon the Messenger of Allah, his family, companions and those who follow him. As for what follows: The Mālikī school of thought constitutes one of the fundamental pillars of Libya’s legal-religious identity. It has held a prominent position since the advent of Islam in the region and has been officially adopted throughout the ages, particularly in the domains of fatwa and judiciary. This research—extracted from my doctoral dissertation—aims to examine the contributions of the Libyan state in preserving and promoting the Mālikī madhhab. It highlights the efforts of the Libyan Dar al-Iftāʾ in adopting the Mālikī school as the official basis for issuing fatwas, and applying it to contemporary issues and novel cases. The research problem lies in the insufficient scholarly attention given to documenting and studying the Libyan state’s efforts in nurturing the Mālikī tradition, despite its central role in shaping the country’s religious and judicial reference. The objectives of the study are to outline the features of Mālikī adherence in the fatwas of Dar al-Iftāʾ, and document the official state contributions in reinforcing this school through the work of the Dar. The study adopts an inductive approach to collect relevant fatwas, decisions, and examples from Dar al-Iftāʾ, which are then analyzed using a critical-analytical method. The key findings affirm the Dar al-Iftāʾ’s consistent reliance on the Mālikī school as its primary reference in fatwa issuance, the use of authentic Mālikī sources, and the significant role of the state in supporting and institutionalizing Mālikī legal authority..
