تطبيقات القواعد الفقهية الكبرى على الأحكام المستنبطة من سورة البقرة: دراسة استقرائية تحليلية [Applications of the Major Jurisprudential Maxims to the Derived Rulings in Surah Al-Baqarah: An Inductive Analytical Study]
Main Article Content
Abstract
aims to explore how the major jurisprudential maxims are applied to the rulings derived from Surah Al-Baqarah, in an effort to gain a deeper understanding of how these maxims are extracted from Qur’anic texts. The problem of the study centers around questioning whether practical applications of these maxims exist within the surah, and whether they form an integral part of the Islamic legislation conveyed in its verses. To achieve this, the study adopts an inductive and analytical methodology, whereby the relevant verses were examined and analyzed in terms of their legislative and jurisprudential content. The findings reveal a clear presence of applications of the major jurisprudential maxims in the rulings derived from Surah Al-Baqarah, such as the maxim “Matters are judged by their objectives” in the rulings related to intention, the maxim “Certainty is not overruled by doubt” in financial transactions, and the maxim “Hardship begets ease” in the rulings related to fasting.
