Abstract

In this study, the concept of the Islamic constitution, its stages of development, its sources, and its distinguishing features from the positive constitution are briefly presented.The purpose of the study is to identify the Islamic constitution's statement of goals and explain how everything it contains is accepted or rejected by Sharia law. The inductive method and the analytical method were both used by the researcher.And he came to conclusions based on the existence of the document or newspaper that was written at the time of the Prophet - may Allah bless him and grant him peace - including that the constitution has a long history that extends over the ages from the initial rise of Islam.And that the concept of the Islamic constitution derives from the fact that Islamic Sharia, with its provisions and texts, is appropriate for all times and is not-as some claim-limited to the state of prophecy and the rightly-guided caliphate after the Holy Prophet - may God bless him and grant him peace - but rather that Islamic Sharia is the most extensive and general constitution.Similarly, the selection of the imam and the emir, as well as his rights and duties, and what are the rights and obligations of people above him, are all clearly outlined in the Qur'an, the Sunnah, and Islamic law.
