Abstract

The problem of this research is that there is an imbalance in the control of terrorism in addition to the complexity of the subject and its seriousness, in addition to how terrorism transcends many borders in terms of human rights. Moreover, terrorism is linked in general to intimidation, terrorization and violence with their impact on society and the individuals. Therefore, the goal of this research is to define the meaning of terrorism, to exhibit how terrorism is seen from the view of Islamic jurisprudence, and to emphasize the role of scholars in spreading human values and the spirit of tolerance and co-existence among the members of both Muslim and non-Muslim communities. In this research, the analytical and descriptive approaches were followed in addition to the inductive approach by referring to references and theoretical researches related to terrorism and its problems, either in the legacy of Islamic jurisprudence or international laws, and then analyzing the data and evidences, be they researche, articles, or books to derive results that serve the research. Most importantly, the research shows that the causes of terrorism vary according to the different political, religious, economic and social circumstances of each society. Shortage of sound lslamic knowledge as received from its authentic sources and following one’s whims and the steps of Satan causes falling into terrorism. Both terrorism and crime aim to spread terror and horror in the hearts of the people in a systematic and continuous manner. There is an important impact for the application of shari`ah penalties in reducing terrorism and the achievement of justice.
