The Reasons for Disliking the Sale of Al a’ina by the Latest Shafi’i Scholars

Abstract

All praise is due to Allah, and Allah's Peace and Blessings be upon His Final Messenger: The problematic of this research lies in the importance of the “Al a’ina” trade. Although, it holds importance in the Shafi school of thaught, the latest scholars the Shafi’ia didn’t mention the reason for the ruling concerning this trade. Because of this, the goal of this research is to clarify the reasons of the ruling.

The researcher relied in her scientific method on the deductive approach from the Noble Qur’an and the teachings of the Prophet (PBUH) . She also relied on The inductive method in extrapolating the books of the old in the question of the “Al a’ina”, as well as the books of the contemporaries, then the analytical approach to the analysis of elements and parts of the research, then the comparison to compare the words to reach the fruit of the research. One of the most important conclusion that the researcher reached from this study is that the most correct opinion is that of the majority of the scholars which is forbidding the trade because the “Al a’ina” trade leads to usury.
