Abstract

This research aims to authorize some of the issues of the jurisprudence of voluntary fasting which has different opinion regarding provisions of clemency and restriction. However, the problem is the lack of specific sources in terms of fundamental curb rules and the absence of practical applications of those rules on the provisions of jurisprudence in general and particularly the provisions of volunteer fasting. This is due to that the scholars previously have referred to the provisions of restriction a few and scattered applications; hence the importance of research in allocating the volunteer fasting, to study in light of the rules of release and restriction. The researcher has collected the scientific citations and references from the books of principles and books of jurisprudence. To address this problem, the researcher has implemented the fundamental curb rules on voluntary fasting and has mentioned the scholars’ and authors’ reports. While he has found controversial he was suggesting the most preponderant opinion and proposing in the light of the rules of release and restriction, followed by the inductive, descriptive analytical and co mparative method. The researcher could conclude out of his results that the six days of Shawwal on Its permissibility to fast in succession after the day of Eid or separately during the month of Shawwaal. The three days that you fast each month are not the white days rather they are restricted and unconditional. The fasting on Friday is confined to fasting the day before or after. The text contained in the prohibition of fasting on Saturdays comes with a record indicating that there are other restrictions t hat have reached twenty- two in total in text and in concept. The prohibition will remain on designating Saturdays for fasting, with its allocation and maximization, not fasting the Kuffarat and the definite Sunnas and the usual supplications
