Abstract

This research verifies the rule of public interest (Masalih Mursalah) and its status in the Islamic legislation, particularly in case this interest receives neither consideration nor cancellation. Public interest is what the legislator has neither considered nor cancelled them. The problem of this research focuses on the issue of implementing the rule of public interest in managing public treasury of the Government of Kwara state in Nigeria, and investigate whether the authority follows the rule of public interest in its transactions. This study aims at highlighting the significance of the rule of public interest in the behavior of the authority in managing the public treasury, stating the controlling terms the authority of the State has to abide by in managing the public treasury, and clarifying the extent of implementing it in the State of Kwara in Nigeria. The researcher adopted the historical, inductive and descriptive methodology in presenting scholars’ opinions about the authority management of the state public treasury. The researcher concluded that the rule of public interest has a great significance and vast role in the field of governance and politics. It is considered as the third source of the Islamic political legislation because of the novel matters, situations and calamities, particularly in the present. After tracking and investigating the political system of Kwara State, the researcher found that it agrees with the objectives of the Islamic Sharia in terms of achieving people’s public interest and protecting them from corruption and harms. Also, the authority works and behavior with the citizens in maintaining reform and prosperity of the individual and groups in the Kwara State in accordance with the other states so that all people in every state can achieve their interests.
