CONDITIONS FOR APPOINTING A JUDGE IN THE QATARI JUDICIAL LAW IN LIGHT OF ISLAMIC JURISPRUDENCE

Abstract
Fair judiciary is one of the most important principles emphasized by Islam, as it is a fundamental pillar for establishing justice, maintaining security, and ensuring peace in society. It is also a key component of sustainable development aimed at building a civilized and conscious community. The responsibility of the judiciary in Islamic jurisprudence remains a significant duty and a great trust for those who hold judicial authority. Therefore, Islamic jurists have meticulously outlined precise qualifications and conditions for appointing judges, which are rarely found in modern legal systems. From this standpoint, the motivation for this study arose, posing the question: Does Qatari judiciary law adhere to the qualifications and conditions set for judges as outlined in Islamic jurisprudence? The aim is to highlight the actual qualifications for judges within Qatari judiciary law, compare them, and evaluate them considering Islamic jurisprudence. This will be done by reviewing, clarifying, and attempting to analyse these conditions to reach the desired conclusions. The key findings of this research indicate that Qatari judiciary law pays close attention to the conditions for appointing judges as considered in Islamic jurisprudence, and that these conditions have a significant impact on judicial authority. The researcher emphasizes that those responsible for appointing judges should be aware of and apply these conditions, while those in judicial positions must also possess the required attributes and qualifications.
