Abstract

This research is an applied study of the maxim of avoiding disagreement, by applying it to emerging cases midst the Corona epidemic, for the proper handling of new incidents, developments and the resulting disagreements in the scientific field, to obtain the clearance of liability related to the revelatory rulings, and preserve the brotherhood of faith among the students of knowledge.


I did not find, according to my research, anyone who focused on this maxim in a specific study, and I followed in this research the reliable scientific method, thus I relied on two approaches: The first is: the descriptive approach: by explaining the concept of the maxim, its evidence, its consideration amongst scholars, and the conditions required for its applicability in jurisprudential rulings. The second approach is the applied approach: by explaining the cases where the maxim does not apply, and the cases to which the maxim applies, and that is through presenting the maxim's cases, their evidence, and explaining the opinions of jurists regarding them. The research concluded with several important results, including: the importance of controlling cases of disagreement in order to prevent their exploitation in producing statements that have no basis in Islamic law, and that is by explaining and differentiating between considered disagreements, and disagreements that are not considered.
