THE EFFECT OF PRONOUN REFERENCE ON DIRECTING THE RULES OF THE ISLAMIC FIQH: A THEORETICAL APPLIED STUDY

This paper titled ''The Effect of Pronoun Reference on Directing the Rules of the Islamic Fiqh'' aimed at addressing the reference of pronouns in the Arabic grammar and its effect on the legislative rule due to research and scientific problems encountered by old and contemporary jurists. These problematic anaphoric references are available in some Quranic and prophetical texts. Such problems cause outstanding disputes among jurists due to the variety of rules of pronoun references in the Arabic grammar. Because it is difficult to address all these rules in this paper, this study addressed three rules only due to their great effect on creating dispute among jurists. To achieve the objectives of the study, an applied study was conducted to show the results of the dispute and its effect on the Islamic fiqh. Using deductive and inferential descriptive approaches, the Quranic verses that involve fiqh differences were presented and the way jurists directed their legislative rule, accordingly. Based on this analysis, a number of conclusions were revealed. The most important ones were: the pronoun reference, as an inferential-approach-based, was considered as a source of disputes among jurists; and the topic of pronoun in the Arabic grammar played a significant role in creating fiqh disputes among jurists; that is, due to its multiple rules, a variety of doctrine opinions and attitudes appeared.
