Abstract
This study, which included an introduction and two sections, aims to demonstrate the effectiveness of the administrative judiciary’s oversight of the administrative control authorities, by explaining the concept of administrative control, its objectives, methods, and the scope of its application in normal and exceptional circumstances, and the administrative judiciary’s oversight of the administrative control authorities in normal and exceptional circumstances in Jordanian legislation.
In this study, I followed the descriptive analytical approach, which is based on reviewing the legal texts that dealt with the administration’s responsibility for its control actions in normal and exceptional circumstances in Jordanian legislation, and the discretionary authority it enjoys, through which it takes all necessary measures and procedures necessary to confront the circumstances that the state is going through. .
Whereas the oversight of the administrative judiciary enshrines the principle of legality and accountability of the administration for its disciplinary actions affecting the rights of individuals and their public freedoms. The administration is responsible for its control actions within the limits of its powers in application of the principle of legality, to protect individual rights and achieve justice.
The study recommends the importance of strengthening judicial oversight over administrative control authorities in all circumstances, to protect the rights and freedoms of individuals, limit the administrative control authorities from exceeding their limits, and not exaggerate the use of their powers except to the extent that is sufficient to maintain public order and the stability of society. The necessity of respecting the legislation regulating its work and not exceeding it.
