Competitions’ Agreement A Comparative Jurisprudence Study Between Islamic Jurisprudence and Jordanian Civil Legislation

Abstract

“Competitions” is one of the most important topics in Islam due to the lake of information about it among most of people. This reason encouraged researchers to dig deep into the Islamic sharia in order to search for types and rules   of competitions. Research Problem lies in identifying the nature the competitions’ agreement, terms and conditions.     These reasons led the researcher to conduct a research over this key Sharia topic “Competitions’ Agreement A Comparative jurisprudence Study between Islamic jurisprudence and Jordanian Civil Legislation”, then the researcher compared this Sharia topic to the Jordanian Civil Legislation in form of a legal comparative research, explaining Sharia Laws in the most possible manner, highlighting and showing differences between Islamic jurisprudence and Law . The researcher followed Descriptive and Analytical Methods in performing this research.   The Research Summary and its key result indicate:  It is crucial to raise the awareness among people over the sharia aspects of Competitions as there are different models and types of competitions that vary based on goals and aims. Islam has permitted these competitions as long as they do not contradict with the Sharia and by using the allowed means.  Islam is flexible when it comes to competitions, in the past, the permission was made for certain types of races only, and then the Sharia specialists performed the “Qiyās” process on variety of modern competitions and permitted them.  The main aspect of permitting these modern competitions was the fact that they help in building one’s body and prepare them for Jihad. And to prevent falling in an act of gambling, Islam founded the so-called ‘Intervening Player”.
