Abstract
The problem of this Research lies in the fact that the Islamic religion, including jurisprudence, is based on facilitation. Facilitation and mitigating difficulties are two features of this law. It is Allah's mercy to make it easier for us to worship Him and understand His purpose, the emphasis that was imposed on previous nations was taken away. It was necessary to identify the most important features of that facilitation and its most prominent features. The Research aimed to explain what is meant by facilitation and mitigate difficulties in Islamic law, present the grounds for facilitation and mitigate difficulties in Islamic law and identify the sections of facilitation and mitigate difficulties in Islamic law. It also aimed to know the rules of facilitating work and mitigating difficulties in Islamic law. At the end of the Research, the most important objectives were as follows: to facilitate and mitigate difficulties in Sharia and the use of jurists does not deviate from the linguistic meaning. There is no school of thought of the four schools of thought that is easier than others in general, nor narrower and harder than others in general, but it may be more facilitating in one chapter, and less in others. Likewise, there is no chapter of jurisprudence in which one of the schools of thought is more facilitating in all its issues, nor narrower in all its issues, but one of the schools of thought may be more facilitating in one chapter in general, than the rest of the other school of thoughts in the same chapter. The Research mentioned some evidence of facilitation and mitigating difficulties in Islamic law from the Qur’an, Sunnah, and the consensus of the nation. It showed that facilitation and mitigating difficulties are divided into two parts: the first: original facilitation in Sharia and the second: facilitation and emergency mitigation. Each of them has its forms and causes. The facilitation and mitigating difficulties are restricted by controls governing it, otherwise, the religion would be lost under the pretext of facilitation. Every day, we would hear a squawk calling to make what is forbidden and to forbid what is lawful under the pretext of facilitation and mitigating difficulties.
