Abstract

Imam Muwaffaq al-Din Ibn Qudamah is one of the prominent figures of the Hanbali school of Fiqh, as he is the author of beneficial works and compilations. One of his most influential works is the book Al-Muqni', which is a reference for the studies in the Hanbali school. One notable explanation of Al-Muqni' is by Imam Al-Munji bin Uthman Al-Tanukhi (died 695 AH), titled Al-Mumti' Fi Sharh Al-Muqni'. The importance of this explanation lies in the scholarly status of Imam Al-Munji, along with its clear presentation. It also includes references to evidence from the Quran, Sunnah, Athar (narrations from companions), and Qiyas (analogical reasoning) on various issues and narrations mentioned by the author of Al-Muqni'. The research problem lies in the fact that the book Al-Mumti has been published with an incomplete version, leaving only the chapter “Divorce” missing from the book. A complete copy of the book was found with the missing chapter. The copy was dedication to His Majesty King Salman bin Abdulaziz Al Saud – may Allah protect him. The present research has undertaken the task of studying the chapter of this book that starts from the author's statement: “If an ordinary person says: ‘You are divorced upon entering the house,’” up to a chapter on his commentary regarding pregnancy. I hope that this research achieves its main objective by presenting the text in its intended form by the author and preserving our nation’s heritage from being lost. It should be presented in a concise manner for students of Islamic knowledge. The research has followed a scholarly scientific methodology for heritage preservation, ensuring that the author's words are accurately presented, citing the sources, referencing Quranic verses, and documenting the opinions attributed to the scholars of the Hanbali school, as well as explaining any unusual or obscure terms.
