ABSTRACT
This research deals with the title: Defenses of Imam Ibn Ashour d. 1393 AH on the authority of Imam Al-Qarafi d. 648 AH through his book: 'At-Tawdih wa-Tatthir li-Mashakil Sharh Tanqih al-Fusul fi Usul al-Fiqh' (Clarification and Rectification of Issues in the Explanation of Chapters on the Principles of Fiqh)." The research aims to uncover some of the defenses made by Imam Ibn Ashur in support of Imam Al-Qarafi (may Allah have mercy on them). It is part of the field of Usul al-Fiqh (Principles of Islamic Jurisprudence) studies, in which scholars defend others to clarify ambiguous statements and remove misunderstandings. The researcher follows an inductive-analytical approach, citing the text of Al-Qarafi followed by the text of Ibn Ashur. The researcher clarifies the issue and presents the opinions of the scholars on it. Then, a preference is given to one opinion over another based on the evidence supporting that opinion. During this study, it became apparent that some of Ibn Ashur's defenses were attempts of personal interpretation. Some defenses relied on the works of other scholars, in addition to the Quran and Sunnah, to support their arguments. It is evident that the process of Usul al-Fiqh defenses among scholars is considered a communal obligation (fard kifayah), which means it must be fulfilled if no one else has done so. The researcher also emphasizes the importance of clarifying Al-Qarafi's intentions in his statements to avoid misinterpretation. Ibn Ashur used excerpts from Al-Qarafi's text and commented on them, employing elegant and admirable methods in his defenses. The researcher chose what he considered to be the most likely opinions of scholars to what appeared to be the most preferable opinion based on the available evidence.
