ISSUING THE FATWA BASED ON THE PRECAUTION ACCORDING TO SHEIKH IBN UTHAYMEEN - AN APPLIED STUDY IN THE CHAPTER ON ABLUTION

 This research aims to reveal an origin of the origins of the Islam, and a rule of the rules on which Islamic law is built, a comprehensive rule for many issues scattered in the chapters of jurisprudence and its principles, a rule upon which scholars have relied, past and present, a rule that still revolves around many questions, and its theoretical and practical reality is surrounded by ambiguities many, but it is a rule Precaution, and since this rule is of this status, it was necessary to know its importance and its role in building legal rulings, and to know its truth and legal purposes, and when the jurist resorts to it, and complies with it. The methods used in this research are Inductive, analytical and comparative Methods, by collecting a sample of the issues in which the sheikh built the fatwa on the precautionary basis in the book of purity, and studying it to reach the results and achieve the goals, and a comparison between the sheikh’s sayings with the sayings of the jurists, and the research concluded that precaution is an important asset in Islamic law , and that it is Matters agreed upon by the jurists, and if there is a disagreement, it is only in some parts or branches, and it does not become a precaution from the beginning, but rather when it is not possible to understand the ruling from its perspectives.
