Abstract

The judicial system in Islam is an integrated system that guarantees justice for parties to the dispute. In order to ensure that justice, the judge was given conditions and duties and guaranteed rights; Hence the objectives of the idea are: to determine the conditions of the judge in Islam, to clarify his duties and to know his rights through the four schools of jurisprudence. The research reached the conclusion that the judicial system in Islam set out conditions that guarantee the impartiality of the judiciary and find the truth in its judgments. It specified the duties of the judge that also contribute to the justice of the judiciary. On the other hand, it ensures that it is entitled to defend itself from certain duress that corrupts its judgements or deviates from justice, which is the objective of the judicial system. To this end, the research used the inductive approach to extrapolate the opinions of jurists, followed by the analytical approach in analyzing those opinions and determining their results.
