Denial of Knowledge of Disagreement among the Fundamentalists

Abstract

This research addresses the topic of denial of knowing the disagreement among the fundamentalists. This research intends to explain the term the qualified scholars and jurists use: (we do not know a disagreement on it). The issues of the research lie in that the Islamic jurists and scholars sometimes express the consensus by saying: (We do not know a disagreement on it), so there is equivocation in that. Is the saying of scholars and jurists: “We do not know a disagreement on it”) considered as consensus and taken as an evidence? The researcher reviewed the definition of consensus, and explained its types, then mentioned examples of that. The researcher raised a question about the scholar’s saying: I do not know a disagreement on it through the identification of the dispute area and the mention the opinions of the fundamentalists. Key findings reached by the researcher are that some scholars consider that this is a form of consensus, but others did not consider it a consensus, and the others made a detailed explanation. It becomes clear that there is a difference between the term of consensus and the term of “I do not know a disagreement on it” that it is not as consensus. Therefore, it shows the importance of identifying the phrases of consensus because it is one of the sources of legislation.
