أحكام التتابع في صيام الكفارات دراسة فقهية مقارنة

الملخص

الحمد لله ولي النعم، وقاضي الحاجات، وقابل الدعوات، ومحقق الرغبات، والعافي عن الزلات، والصلاة والسلام على النبي المجتبى، صاحب الدرجات، ورافع لواء الشفاعات، وارض اللهم عن الأصحاب والزوجات، وعن سائر المسلمين والمسلمات، وبعد:

الإنسان من طبيعته الخطأ والغفلة، وربما لدوافع معينة يرتكب المسلم أخطاء تستوجب منه الكفارات والتي إحداها الصيام، وهذا الصيام تارة يجب متتابعًا، وتارة أخرى يجب غير متتابع، وإذا كان الصوم متتابعًا فتارة تطرأ عليه أعذار لا تؤثر فيه بالانقطاع، وتارة أخرى تطرأ أشياء قاطعة ومبطلة لهذا التتابع، وترتبط بهذه الأحكام أحكامًا أخرى لا يسع المسلم جهلها؛ لأنها مما تعم به البلوى في هذا الزمان، بل وفي كل الأزمان والعصور؛ لكون هذه الأحكام تخص جوانب العبادات، وهي من الثوابت في الشريعة الإسلامية، ومن هنا جاءت أهمية هذا البحث، فهو يعالج  أحكامًا وقضايا تهم غالب المسلمين، ورغم وجود أغلب مسائل هذا البحث في ثنايا الكتب الفقهية إلا أنني جمعت المتناثر منها.

والبحث يهدف إلى دراسة آراء الفقهاء في التتابع الواجب في صيام الكفارات، ثم تحليل آرائهم والمقارنة بينها لاستخلاص الرأي الراجح منها، وكان منهجي في البحث أنني أجمع آراء الفقهاء في كل مسألة، وأدرس خلافهم وأدلتهم فيها، وأرجح في المختلف فيه، وقد رجح عندي ما قوي دليله، وحسن مقصده، وكان ميزاني في ذلك إعمال الدليل لا إهماله، ونبذ التعصب لا انتهاجه، وكان من أهم نتائج هذا البحث أن: ما لا يقطع تتابع الصيام الحيض، والنفاس، والمرض، والسفر، والإغماء أثناء النهار، وفطر الحامل والمرضع، والفطر بسبب الإكراه، والجماع في ليالي شهري الكفارة إلا كفارة الظهار، فالجماع في لياليها يقطع التتابع، وكذلك إن أفطر المكفر ظانًا عدم طلوع الفجر وقد طلع أو غروب الشمس ولم تغرب، وإن تخلل الشهرين أحد الأيام المحرم صيامها كالعيدين، وكذا إن تخلل الشهرين شهر رمضان، وأن مما يقطع تتابع الصيام، إن صام أثناء الشهرين يومًا أو أكثر بنية التطوع أو النذر أو القضاء أو كفارة أخرى، وجماع الزوجة في الليل من زمان كفارة الظهار، وكذلك إن دخل في صيام الكفارة ثم وجد الرقبة، فما كان فيه من صواب فمن توفيق الله تعالى، وما فيه من خطأ فمن نفسي ومن الشيطان وأبرأ إلى الله منه.
